1. Acceptance of Terms

By accessing or using medita.kitchen (the “Site”) or ordering from Medita Kitchen (the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Site or Services.

2. Description of Services

Medita Kitchen prepares and delivers freshly made Mediterranean-inspired meals to customers within our designated local delivery area. Menu offerings, availability, pricing, and delivery days are subject to change at our discretion.

3. Orders and Payment

• All orders must be placed and paid for through the Site prior to delivery.
• Payments are processed securely through Stripe. By placing an order, you authorize us to charge your provided payment method for the total order amount.
• Prices are listed in U.S. dollars and are subject to change without notice; however, changes will not affect orders already placed and confirmed.
• We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or inability to fulfill delivery.

4. Delivery

• Delivery is currently offered only within our designated local service area.
• Delivery days and windows are communicated at the time of ordering and are subject to change.
• You are responsible for ensuring someone is available to receive the delivery, or for providing safe delivery instructions. Medita Kitchen is not responsible for spoilage or quality issues resulting from delayed retrieval after delivery.

5. Allergens and Dietary Information

Meals may be prepared in a kitchen that also processes common allergens, including but not limited to dairy, tree nuts, shellfish, gluten, and eggs. While we make reasonable efforts to accommodate dietary preferences and disclose ingredients, customers with food allergies or medical dietary restrictions are solely responsible for reviewing ingredient information and consulting with a medical professional as needed before consuming our meals. Medita Kitchen is not liable for allergic reactions or adverse health effects resulting from consumption of our meals.

6. Cancellations and Refunds

• Cancellation requests must be made within the timeframe specified at checkout or in your order confirmation.
• If a meal arrives damaged or does not meet quality expectations, please contact us within 24 hours of delivery so we can make it right (refund, credit, or replacement, at our discretion).
• Refunds for issues outside our control (e.g., customer unavailability at delivery, incorrect address provided by customer) are not guaranteed.

7. Account Responsibilities

If you create an account with us, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Please notify us immediately of any unauthorized use.

8. Intellectual Property

All content on the Site, including recipes, photography, branding, logos, and written content, is the property of Medita Kitchen and may not be reproduced, distributed, or used without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Medita Kitchen shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services, including but not limited to loss of enjoyment, inconvenience, or damages related to food quality, allergic reactions, or delivery delays, except where such liability cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Medita Kitchen, its owners, and staff from any claims, damages, or expenses arising from your misuse of the Site or Services, or violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles, unless otherwise required by applicable consumer protection law.
